Terms of sale

1. Who we are

These terms govern the sale of digital image files ("photographs") by O'Gara Photography ("we", "us", "our") to you ("you", "the customer") through this website. By placing an order you agree to these terms.

2. Orders and payment

Prices are shown in GBP and are payable in full at checkout. Payment is processed securely by Stripe; we do not store your card details. Your order is a request to buy; a contract is formed when we confirm payment has succeeded and issue your download links.

3. Digital delivery

Photographs are delivered as digital downloads only. After successful payment you will receive time-limited download links, both on screen and by email. Download links expire after 14 days and permit a limited number of downloads per item; if you have trouble downloading within that window, contact us and we will help.

4. Licence and permitted use

On payment you receive a personal, non-exclusive, non-transferable licence to use the purchased photographs for personal, non-commercial purposes. Copyright remains with us at all times. Full licensing terms are set out on our copyright & licensing page.

5. Right to cancel and refunds

Because we supply digital content that is delivered immediately, you agree that by downloading a photograph you consent to delivery beginning at once and acknowledge that your statutory 14-day right to cancel under the Consumer Contracts Regulations 2013 is lost once a download has started. This does not affect your rights if a file is faulty or not as described — in that case we will replace it or provide a refund.

6. Faulty files

If a downloaded file is corrupt or will not open, tell us within a reasonable time and we will re-issue it. If we cannot supply a working file we will refund the amount you paid for that item.

7. Pricing and availability

We may change prices at any time, but changes do not affect orders already confirmed. Occasionally a gallery or photograph may be withdrawn; if we cannot fulfil a paid order we will refund it in full.

8. Our liability

We do not exclude or limit our liability where it would be unlawful to do so. Subject to that, our total liability for any order is limited to the amount you paid for it. We are not liable for losses that were not foreseeable or that arise from your own misuse of the photographs.

9. Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

10. Additional notes

Digital downloads are delivered immediately after payment. No VAT is charged (not VAT registered).
